NetScout Exempted from $3.3 Million Payout Over Nixed Patents by Fed. Cir.

The Federal Circuit issued opinions invalidating patents owned by Packet Intelligence LLC and awarding related infringement damages of $3.35 million against network security company NetScout Systems Inc.

The decisions handed a victory to NetScout, which had been fighting Packet’s lawsuit since 2016 in the U.S. District Court for the Eastern District of Texas and through two appeals. One upheld an administrative court’s invalidation of the patents in question – related to the transmission of information over a computer network – in a separate case, while the other reversed the decision against NetScout and remanded the case for dismissal.
